Terms of Use

This English translation is provided for reference. The Spanish version is the legally binding text.

By accessing or using the logwell.mx website you agree to be bound by these Terms of Use. If you do not agree with any of the conditions set out here, please do not use this site.

These terms apply to all visitors, registered users and anyone who accesses the content or digital services offered by Grupo Logístico Logwell, S.A. de C.V.

You agree to use this website only for legitimate purposes related to cross-border trade and logistics services. The following is expressly prohibited:

• Attempting to gain unauthorized access to Logwell’s or third parties’ systems, networks or data
• Using automated tools (bots, scrapers) to extract content from the site
• Publishing, transmitting or distributing content that is unlawful, defamatory or that infringes third-party rights
• Impersonating Logwell, its employees or any other entity
• Interfering with the operation of the site or its digital services

The content published on logwell.mx, including text, images, logos, icons, source code and page structure, is the property of Grupo Logístico Logwell, S.A. de C.V. or its licensors, and is protected by Mexican and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and view the content for personal informational purposes. Reproducing, distributing or modifying it without Logwell’s written authorization is prohibited.

The tracking tool available on this site lets active clients check the status of their operations using an assigned tracking number. By using this tool, you accept that:

• You should only look up tracking numbers for operations you are legitimately authorized to view
• Unauthorized access to third-party information is prohibited and may constitute a computer crime
• The data shown is for informational purposes and may lag the actual status of the operation by up to 2 hours

KAIRO is Logwell’s artificial intelligence assistant. It is designed to guide visitors and clients on services, processes and general cross-border trade questions. By interacting with KAIRO, you acknowledge that:

• KAIRO provides general information; it does not replace the advice of a licensed customs broker
• Conversations may be reviewed internally to improve service quality, as described in the Privacy Notice
• You should not share third-party confidential information or sensitive data in the chat
• KAIRO cannot commit to business agreements or generate binding quotes

Logwell receives inquiries, quote requests and communications through multiple channels. These terms apply equally to all of them, including but not limited to:

• The site’s contact form at logwell.mx/contacto
• The site’s quote form at logwell.mx/cotizar
• The KAIRO assistant (site chat)
• Newsletter subscription
• Email, WhatsApp, phone calls, instant messaging and any other digital channel enabled by Logwell
• Forms hosted at events, trade shows, campaign landing pages and social media accounts operated by Logwell

By submitting information through any of these channels, you represent that:

• The data provided is accurate, current and your own, or you are authorized to share it
• You have the authority to represent the company or person whose data you share
• You will not include third-party confidential information, sensitive data or documentation belonging to other clients without authorization
• You accept the Privacy Notice and the Data and AI Policy applicable to the channel used

Logwell reserves the right to decline, archive or not follow up on any request when: (i) the information is insufficient or implausible; (ii) the operation falls outside Logwell’s commercial scope; (iii) it involves legal, regulatory or reputational risk; (iv) it originates from bots, automated systems or spam schemes; (v) for any other reasonable cause under internal business criteria.

Quotes requested through the website, forms, the KAIRO chat, email, WhatsApp or other channels are processed by Logwell’s sales team. Processing involves human review of the information, validation with operations teams and preparation of a proposal.

Logwell makes several digital tools available to the public and to its clients, all governed by these Terms of Use and, where applicable, by the specific terms published within each tool:

• Public website (logwell.mx) and associated subdomains
• KAIRO assistant in its public web mode and future modes (KAIRO Pro, integrations, etc.)
• Public tracking of references and tracking numbers
• Client portal (private area), once available and under its own terms
• Blog, newsletter and editorial content published by Logwell
• Internal APIs and public endpoints (quotes, contact, tracking, telemetry, chat)
• Mobile apps, messaging integrations and bots operated by Logwell, current or future

With respect to all of these tools, you acknowledge and accept that:

• They are offered “as is” and “as available”, with no guarantee of continuous availability, absolute accuracy or fitness for a particular purpose
• They may be modified, suspended or discontinued at any time, in whole or in part, without giving rise to any right to compensation
• They may depend on external computing, messaging, AI, hosting or connectivity providers whose outages are beyond Logwell’s control
• Your use of them constitutes acceptance of these terms, the Privacy Notice, the Cookie Policy and the Data and AI Policy, in their current versions
• Any result, data, estimate, reference number, quote or information obtained through these tools is indicative and must be validated with a Logwell specialist before making operational or financial decisions
• Reverse engineering, unauthorized automated probing, denial-of-service attacks, mass scraping or any attempt to access information you are not authorized to view is prohibited

The limitation of liability set out in section 10 of these terms applies fully and jointly to all the tools listed, as well as to any future digital tool Logwell makes available to the public.

The information published on logwell.mx is for general informational purposes. The specific conditions of services, rates, routes and operations are established in the individual contracts with each client.

Although we strive to keep the content current, Logwell does not guarantee that the information is free of errors, omissions or regulatory lag. Tariff schedules and trade regulations change frequently; always confirm with your account executive.

To the fullest extent permitted by Mexican law, Logwell shall not be liable for:

• Direct, indirect, incidental, special or consequential damages, lost profits or lost business opportunity arising from the use of, or inability to use, the site, digital tools, forms, the KAIRO chat, tracking, APIs, the newsletter, the portal or any other platform operated by Logwell
• Service interruptions due to maintenance, technical failures, unavailability of external providers (computing, AI, hosting, messaging) or force majeure or unforeseeable events
• Decisions made based on information published on the site, generated by KAIRO, shown in tracking or delivered by any digital tool without validation by a Logwell specialist
• Delays, lack of response or the decision not to serve quote requests, contact inquiries or any communication received through any of Logwell’s channels, given that the published timeframes are indicative and do not constitute an SLA
• Differences between indicative quotes and the final formal proposal, as well as changes driven by exchange rates, fuel prices, tariffs, countervailing duties or any regulatory or market factor beyond Logwell’s control
• Misuse of the digital tools, or unauthorized access caused by the user’s negligence in safeguarding credentials, tracking numbers or sensitive information
• Third-party content linked or referenced from the site, and the actions or omissions of external providers with whom the user has a direct relationship

This limitation applies fully and cumulatively to all the tools and platforms described in section 08 of these terms, including any future digital tool developed or adopted by Logwell.

In any event, Logwell’s total aggregate liability arising from or related to the use of the site and its digital tools shall be limited to the amount actually paid by the user to Logwell for services contracted in the twelve (12) months preceding the event giving rise to the claim, or the amount in Mexican pesos equivalent to 1,000 UMA (Unidad de Medida y Actualización, Mexico’s statutory reference unit), whichever is lower.

These Terms of Use are governed by the laws of the United Mexican States. For any dispute arising from the interpretation or performance of these terms, the parties submit to the jurisdiction of the competent courts of Nuevo Laredo, Tamaulipas, expressly waiving any other venue to which they might be entitled.

If any provision of these terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
